RELEASE OF LIABILITY
Anesthesia-Free Teeth Cleaning Waiver
In exchange for participation in the activity of Anesthesia-Free Teeth Cleaning organized by
Happy Dog LLC, of Maryland, and/or use of the property, facilities and services of Happy Dog
LLC, I, _________________________, at address 911 S. Ann St. Baltimore MD. 21231
agree for myself, my pet, and (if applicable) for the members of my family, to the following:
1. AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey follow all posted
rules and warnings, and further agree to follow any oral instructions or directions given by
Happy Dog LLC, or the employees, representatives or agents of Happy Dog LLC. The
information provided by Happy Dog LLC should not be interpreted as professional
veterinarian advice and I agree that Happy Dog LLC is acting in good faith on the information I
provide.
2. ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent
risks associated with the above described activity and I assume full responsibility for personal
injury to myself, my pet, and (if applicable) my family members, and further release and
discharge Happy Dog LLC for injury, loss or damage arising out of my or my family’s use of or
presence upon the facilities of Happy Dog LLC, whether caused by the fault of myself, my pet,
my family, Happy Dog LLC or other third parties. My pet may have underlying health issues. It is
my responsibility to have my pet(s) examined by a licensed veterinarian prior to any type of
procedure. I understand that it is my responsibility to keep my pet up-to-date on all necessary
vaccinations.
3. INDEMNIFICATION. I agree to indemnify and defend hold harmless Happy Dog LLC against
all claims, causes of action, damages, judgments, costs or expenses, including attorney fees
and other litigation costs, which may in any way arise from my or my family’s use of or presence
upon the facilities of Happy Dog LLC.
4. FEES. A 50% deposit is required at time of booking. The 50% balance will be due upon completion of procedure. In the event we are not able to proceed due to dog temperament, stress level and/or lack of safety, you will only be responsible for a consultation fee of $65.00 and the remaining balance of the deposit will be refunded.
I agree to pay for all damages to the facilities of Happy Dog LLC caused by any
negligent, reckless, or willful actions by me, my pet, or my family. If Happy Dog technicians are unable to perform the
procedure due to aggressive behavior or over anxious behavior Happy Dog will cease the appointment
and refund you half of my deposit.
5. APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the
above shall be resolved under laws from the State of Maryland law.
6. NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this
Agreement and that I have been given a reasonable opportunity to review it before signing. I
further agree and acknowledge that I am free to have my own legal counsel review this
Agreement if I so desire. I further agree and acknowledge that Happy Dog LLC has offered to
refund any fees I have paid to use its facilities if I choose not to sign this Agreement.
7. ARMS LENGTH AGREEMENT. This Agreement and each of its terms are the product of an
arm’s length negotiation between the Parties. In the event any ambiguity is found to exist in the
interpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitly
reject the application of any legal or equitable rule of interpretation which would lead to a
construction either for or against a particular party based upon their status as the drafter of a
specific term, language, or provision giving rise to such ambiguity.
8. ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement,
whether standing alone or as applied to a particular occurrence or circumstance, shall not affect
the validity or enforceability of any other provision of this Agreement or of any other applications
of such provision, as the case may be, and such invalid or unenforceable provision shall be
deemed not to be a part of this Agreement.
9. DISPUTE RESOLUTION. Any controversies or disputes arising out of or relating to this
Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If
mediation is not successful in resolving the entire dispute or is unavailable, any outstanding
issues will be submitted to final and binding arbitration under the rules of the American
Arbitration Association. The arbitrators award will be final, and judgment may be entered upon it
by any court having proper jurisdiction.
10. PHOTO & VIDEO RELEASE. I give Happy Dog LLC the absolute right and permission to
use photograph(s) and or video(s) of my pet in promotional materials and publicity efforts. I
understand that the photographs may be used in a publication, social media, print ad, electronic
media, or other form of promotion. I release Happy Dog LLC, the photographer, their offices,
employees, and agents from liability for any violation of any personal and or proprietary right I
have in connection with such use.
11. CANCELATION POLICY. Cancelations made within 24 hours will receive a full refund. Cancelations not made within 24 hours will incur a fee of $65.00. No shows and no calls to cancel will result in a forfeit of your $150 deposit. There is a 15 minute window for your scheduled appointment. If you arrive past the 15 minute window we will need to reschedule your appointment.
I understand that an anesthesia-free teeth exam and cleaning may not be as thorough as an anesthetic dental exam, cleaning, and radiographs, but rather is one part of a complete dental care plan for my pet.

*We cannot prescribe antibiotics or other mediations. If your pet is in need of them, you will need to see your primary veterinarian to acquire them.
I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS
